- • Is the use potentially covered by fair use or fair dealing?
- • Did you authorize the use or license the content?

- • Have you attempted to contact the user directly first?

Valid Reasons for Counter-Notice:
- • The content was removed by mistake or misidentification
- • You have authorization to use the copyrighted material
- • Your use qualifies as fair use
- • The original DMCA notice was defective or fraudulent
- • The copyright claim is invalid or has expired
Required Counter-Notice Information
A valid DMCA counter-notice must include:
1. Your Contact Information
- • Full name, address, phone number, and email
- • Physical address where you can be reached
2. Identification of Removed Content
- • Description of the content that was removed
- • Location where it appeared before removal
- • Copy of the original DMCA notice if available
3. Required Statements
Good Faith Statement
"I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification."
Jurisdiction Consent
"I consent to the jurisdiction of [appropriate court] for any lawsuit that may be filed against me by the person who provided the original DMCA notification."
4. Physical or Electronic Signature
Sign the counter-notice physically or electronically (typed name with "/s/" is acceptable for email).
Counter-Notice Response Process
After we receive a valid counter-notice:
Step 1
We forward your counter-notice to the original complainant
Step 2
We wait 10-14 business days for their response
Step 3
If no lawsuit is filed, we may restore the content
Important: Filing a counter-notice may result in the original complainant filing a lawsuit against you. Consider seeking legal advice before filing a counter-notice.
Repeat Infringer Policy
Policy for Repeat Offenders
VyomA has a policy of terminating, in appropriate circumstances, users or account holders who are repeat infringers of copyright. However, as our platform does not require user accounts for calculator usage, this policy primarily applies to content submission and collaboration.
What Constitutes Repeat Infringement
- • Multiple valid DMCA takedown notices
- • Pattern of copyright violations
- • Ignoring previous warnings
- • Submitting infringing content after notice
Possible Consequences
- • Blocking IP addresses
- • Refusing future content submissions
- • Terminating business relationships
- • Legal action if warranted
Fair Process
We consider the totality of circumstances including the nature and frequency of violations, good faith efforts to comply, and responses to our communications before taking any action.
Protection Against False Claims
Penalties for False DMCA Claims
Section 512(f) of the DMCA provides for liability for damages if you knowingly materially misrepresent that material or activity is infringing. This includes monetary damages and attorney's fees.
What Constitutes a False Claim
- • Claiming ownership of content you don't own
- • Misrepresenting the scope of your copyright
- • Filing claims for content in the public domain
- • Ignoring clear fair use situations
- • Using DMCA for competitive suppression
Our Response to False Claims
- • We may reject clearly frivolous notices
- • We document patterns of false claims
- • We may pursue legal remedies when warranted
- • We educate about proper DMCA usage
- • We support legitimate counter-notices
